Statute of Limitations for Accidents with an Uber Driver

After an accident with an Uber driver, the injury victim may be left waiting while their insurance company and Uber try and figure out who was responsible for the accident and who will pay for damages. During this time, the injured driver may be out of work, seeking medical treatment, and left waiting for a resolution.

If the insurance company or Uber does not come up with a reasonable solution or pay you enough to cover your damages, you may need to take the case to court. However, there is only a limited amount of time to file a personal injury lawsuit in Colorado. If you file the claim too late, the court may dismiss your case and you may be left without any way to recover damages for your injuries.

This is why it is important to contact an experienced Denver personal injury attorney as soon as possible after an accident. Your attorney will negotiate with the insurance company to get your payment quickly, make sure you don't get the runaround, and file a claim in time to maintain your rights in court.

The attorneys at accidentdenver.com have represented victims injured in Uber accidents. We will investigate your claim, deal with the insurance company, and fight to get you the money to replace your car, pay your medical bills, and cover your lost income after an accident. Statute of Limitations for Colorado Car Accidents

The time limit to file a lawsuit is known as the “statute of limitations.” The statute of limitations for most personal injury cases in Colorado is two years. However, the statute of limitations is three years, “all tort actions for bodily injury or property damage arising out of the use or operation of a motor vehicle.”

This means that a driver, passenger, or pedestrian injured in an accident with an Uber driver has three years from the date of the accident to file a personal injury claim in court. Waiting just one day too long may result in having your claim denied.

Statute of Limitations for Victims Under 18

The statute of limitations generally does not begin to run until the time the minor victim turns 18. If a minor is injured in an accident with an Uber driver, the victim would have an additional three years from their 18th birthday to file a claim (or until age 21).

Statute of Limitations in Fatal Accident with Uber Driver

After a fatal accident involving an Uber driver, the victim's family members may be able to file a wrongful death claim to recover damages for the loss of a loved one. A wrongful death lawsuit has a two-year statute of limitations in Colorado. Filing a wrongful death claim would have to be filed within two years of the death of the victim.
